Terms and Conditions of Smart Purse Card

Welcome to the Smart Purse Electronic Money Card (“Smart Purse Card” or “Card”)

With only one Smart Purse Card, your life will be much easier. You will enjoy shopping while receiving Smart Plus Points (“Points”) to redeem for many rewards.

  • Various shops for : you to choose from You will be able to use the Smart Purse Card at the shops having the Smart Purse Card symbol.
  • A variety of Benefits from Smart Purse Card: The Cardholders will obtain Smart Plus Points for any purchase, the more you use the Card the more Points you receive. The Cardholders can receive and obtain Benefits at the participating stores.
    • To collect Smart Plus Points: For each 10 baht purchase of goods or services via Smart Purse Card, the Cardholders will earn one Smart Plus Point, provided that the participating shops may from time to time determine the rate of Smart Plus Points.
    • To redeem Smart Plus Points: 50 Smart Plus Points are worth one baht to be used for redeeming for any goods or services at the participating shop that you choose.
  • How to use Smart Purse Card: Please check the price of the goods or services on the card reader screen before using the Card for making payment.
  • How to top up the Card: The Cardholder can top up the Card each time for a minimum amount of 50 baht but not exceeding the maximum credit for each type of Card at any Seven Eleven shops and other participating shops.
  • Validity of the Card: Three (3) years from the date of first activation of the Card, or during the term set by the Company.
  • How to check balance, Smart Plus Points, and E-Coupons or E-Vouchers: The Cardholders can check the balance on the payment slip after each purchase using the Card.
  • Recommendation: Smart Purse Card should be kept in the same manner as cash. The Company reserves the right not to be responsible for the remaining Monetary Value and any other Benefits in the event of loss of the Smart Purse Card. The balance of Monetary Value in the Card can be refunded in the case where the Card expires, the Card is damaged, or the Cardholder has no intention to use the Card.
  • How to keep the Smart Purse Card: Smart Purse Card should not be pierced, bent, damaged, or scratched, and should not be kept in any place with a high temperature, high humidity, or intense magnetism.

Terms and Conditions of Smart Purse Cards

  1. Definition Unless otherwise specifically defined, the terms used in these Terms and Conditions shall have the following meanings:
    • “Electronic Money Card” means the card issued by the person who operates the business of providing an electronic money card to consumers, in order to be used for payment for goods, services, or any other fees in lieu of cash, and the Monetary Value of the pre-paid amount is recorded on the card.
    • “Thai Smart Card Company Limited” (the “Company”) means the company which is authorised to conduct the business of providing electronic money cards from the Bank of Thailand.
    • “Smart Purse Card” (or the “Card”) means an electronic money card issued by the Company, or jointly issued with other organisations, in order to facilitate the Cardholder for paying for goods, services, or any other fees in lieu of cash at the participating shops.
    • “Computer Chip” means a circuit chip in the form of a small silicon chip, assembled in circuits and electronic devices.
    • “Cardholder” means a holder of a Smart Purse Card: either as a designated Smart Purse Cardholder or an unnamed Smart Purse Cardholder, and duly holding the Smart Purse Card in good faith.
    • “Service Points” means the shops or any other places having an arrangement with the Company to be designated as a point for collecting payment of goods or services and/or providing top-up services of Monetary Value.
    • “Monetary Value” means the Monetary Value of money recorded in the Card at a certain point in time.
    • “Benefits” means all the privileges stored on the Computer Chip of the Card, in the form of Points, E-Coupons and any other privileges to be offered to the Cardholder in the future.”
  2. Obligation
    The Smart Purse Card is issued by the Company under the Terms and Conditions of the Smart Purse Card, which is an agreement between the Company as the Card Issuer and each Cardholder. The Schedule attached hereto shall be considered an integral part of these Terms and Conditions.
  3. Payment for Goods and/or Services
    • 3.1 The Cardholder shall use the Card for making payment for goods or services only at the Service Points designated by the Company.
    • 3.2 The Monetary Value of the Card will be automatically reduced according to the price of goods or services paid and the balance of the Monetary Value of the Card will be displayed on the card reader screen every time the Cardholder makes a payment of goods or services through the Card.
  4. Topping-up Monetary Value
    • The Cardholder, in cash and by paying top-up fees as notified at the Service Points, can top up the Monetary Value on the Card at the Service Points designated by the Company.
    • The Cardholder can top up the Card at the minimum amount of 50 baht for each top-up. However, the topped-up Monetary Value shall not exceed the maximum credit for each type of Card, as determined by the Company.
    • The Cardholder can check the balance of the topped-up Monetary Value from the pay slip of such topped-up Monetary Value issued at the Service Points.
  5. Maximum Credit The maximum credit each type of the Card, at any time, shall not exceed the maximum credit as determined by the Company.
  6. Validity The Card shall be valid for a period of three years (or any period of time as determined by the Company from time to time) from the first activation date of the Card at the Company’s Service Points. The Company grants an extension for the use of the Card of thirty days from the expiry date of the Card to the Cardholders, in order that the Cardholder will be able to use the Card for making payment for goods or services for the amount of money and other Benefits remaining in the Card. Nevertheless, the Monetary Value of the Card cannot be topped up during this extension period.
  7. Fees and Expenses in connection with the Card The Company will charge the following fees and expenses in connection with the Card:
    • 7.1 Card Price for all Types of Card As this fee is not included in the Monetary Value prescribed under the Terms and Conditions, this fee shall not be refunded in cash to the Cardholder.
    • 7.2 Top-Up Fee for Monetary Value The top-up of Monetary Value at the Service Points will be subject to the fee as notified at the Service Points.
    • 7.3 Card Status-Maintenance fee When the Card expires, the Cardholder shall contact the Company in order to claim a refund of the outstanding Monetary Value from the Company within 30 days of the expiry date. After the expiration of such 30 days, the Company will charge a Card Status-Maintenance Fee, by making a deduction from the balance of the Monetary Value as per the rate specified in the Schedule attached to the Terms and Conditions. In the event that the balance of the Monetary Value does not cover the Card Status-Maintenance Fee, the Company reserves its right to immediately cancel the Card without giving any prior notice.
    • 7.4 Fee for refunding the balance of the Monetary Value and other Benefits of the Card. The refund of the balance and other Benefits shall be subject to the fee specified in the Schedule attached to the Terms and Conditions.
    • 7.5 Fee for verification of the payments made through the Card. If the Cardholder wishes the Company to verify the payment made through the Card by issuing an expenditure statement, the Cardholder shall submit a written request to the Company’s Customer Relations Center, and the Company will subsequently verify the payment made through the Card and notify the Cardholder of the result within the period of time determined by the Company. The Company reserves its right to charge a fee for this service at the rate specified in the Schedule attached to the Terms and Conditions. The payment method shall be subject to the procedure prescribed by the Company.
  8. Defective Card
    • 8.1 If there is a defect in the Card issued by the Company, which makes the Card unable to be first activated at the Service Points, the Cardholder can request a new Card.
    • 8.2 If the Card is defective within 15 days from the first activation date, the Cardholder shall contact the Company through the following channels:
      • 8.2.1 For defective Cards, if the Company, after investigating according to the standard of the Company, finds that the defect originated in the production procedure, the Company will take the following actions:
      • a. Re-Issuance The Company will issue a new Card to the Cardholder, and transfer all of the Benefits in the defective Card, such as Smart Plus Points, e-coupon, or electronic voucher to the new Card, and the Company will then deliver the new Card to the Cardholder at the address that the Cardholder has notified to the Company.
      • b. Monetary Value in the Card The Company will transfer the remaining Monetary Value in the Card, at an amount equivalent to that contained in the Company’s computerized database, to the new Card of the Cardholder.
      • 8.2.2 In the event that the Card is defective for any other reasons or due to the Cardholder’s act, either intentionally or negligently, the Company will not be responsible for issuing a new Card and will take the following actions:
      • a. The Company will notify the Cardholder that the defect of the Card is not the Company’s responsibility.
      • b. If the Cardholder wishes to buy a new Card, the Company will transfer the remaining Monetary Value in the Card, at an amount equivalent to that contained in the Company’s computerized database, to the new Card of the Cardholder.
      • c. If the Cardholder does not wish to buy a new Card, but wishes to cancel the Card, the Cardholder shall deliver the Card and relevant documents as prescribed in Section 7 of the attached documents of Schedule of Terms and Conditions of Smart Purse Card. to the Company, and the Company will then transfer the remaining Monetary Value in the Card, at the amount equivalent to that contained in the Company’s computerized database, to the designated bank account of the Cardholder that is notified to the Company. In this regard, the Company will charge a fee for this service at the rate specified in the Schedule attached to the Terms and conditions.
      • d. With regard to the Benefits in the defective Card, in the event that the Cardholder buys a new Card, the Cardholder may contact the Company’s Customer Relations Center to request the Company to transfer any remaining Benefits in the defective Card to the new Card.
    • 8.3 If the Card becomes defective after 15 days from the first activation date, the Company shall not be responsible for issuing a new Card and will take the following actions:
      • 8.3.1 In the event that the Cardholder wishes to buy a new Card, the Company will transfer the remaining Monetary Value in the Card, at the amount equivalent to that contained in the Company’s computerized database, to the new Card of the Cardholder.
      • 8.3.2 If the Cardholder does not wish to buy a new Card, the Company will then transfer the remaining Monetary Value in the Card, at the amount equivalent to that contained in the Company’s computerized database, to the designated bank account of the Cardholder that the Cardholder notifies to the Company.
      • 8.3.3 With regard to the Benefits in the defective Card, in the event that the Cardholder buys a new Card, the Cardholder may contact the Company’s Customer Relations Center to request the Company to transfer the remaining Benefits in the defective Card to the new Card.
    • 8.4 Reservation
      • 8.4.1 The Company has no policy to transfer data and remaining Benefits from a defective Card to more than one new Card and the data can only be transferred to a new Card of the same type as the defective one. The data transfer is at the Company’s sole discretion.
      • 8.4.2 In the event that the remaining Monetary Value in the defective Card is lower than or equal to the processing fee for the transfer of the Monetary Value , and the Cardholder does not wish to accept the transfer of the remaining Monetary Value and wishes to be refunded , the Cardholder shall personally collect such refund at the place specified by the Company.
      • 8.4.3 In the event that no data can be retrieved from the defective Card, or it cannot be proved that the defective Card was issued by the Company, no new Card can be issued to the Cardholder, and no remaining Monetary Value and/or outstanding Benefits can be transferred to a new Card.
      • 8.4.4 The Company reserves the right not to transfer any Points and Benefits, as well as any other data in the Computer Chip of the Card to another Card if the storage capacity of the Computer Chip of the receiving Card is full. In such a case, the Cardholder shall use the Points and Benefits as recorded in the original Card in order to reduce such data so that it is able to be transferred to the new card.
  9. Verification of the Balance of Monetary Value in the Card The Cardholder can verify the balance of Monetary Value in the Card from the sales slip or at the Service Points determined by the Company.
  10. Verification of transactions made through the Card If the Cardholder wishes the Company to verify the transactions made through the Card, the Company reserves its right to verify only the transactions made through the Card for the 10 days previous to the date on which the Cardholder notifies the Company.
  11. Terms for a cash refund of the remaining Monetary Value of the Card In the case where the Card expires and/or the Cardholder wishes to cancel the Card and the Cardholder would like to refund the remaining Monetary Value of the Card, please see the Schedule attached to the Terms and Conditions.
  12. Theft or loss The Card is regarded as the cash of the Cardholder, if the Card is stolen or lost, or if there is any fraud committed on the lost Card, the Company shall not be responsible for the remaining Monetary Value and/or Benefits stored in such Card.
  13. Intellectual property The Cardholder acknowledges that the intellectual property of the Computer Chip in the Card will remain with the Company. Cardholders shall not transfer, give permission or intimate the right to such intellectual property to any third party to be used for any purpose other than the normal purpose of the Card. The Company is entitled to prosecute any person infringing the owner’s right to the intellectual property under the law of intellectual property.
  14. Amendment, Modification, and Addition to the Terms and Conditions The Company reserves its right to amend, modify, or add to any or all of the Terms and Conditions on the use of the Card. The Cardholder shall be notified in writing or through another channel of such amendment, modification, or addition, at least 30 days in advance.

Terms and Conditions of Smart Plus Reward Program

  1. Definitions
    • “Smart Plus Rewards” means a loyalty program by which the Cardholder can make payment using the Smart Purse Card in order to obtain various Benefits such as accumulation of points, E-Coupons, product discounts and/or other services.
    • “Electronic Coupons (E-Coupons)” means Electronic Coupons occasionally issued to the Cardholder depending on conditions set forth by the Company and/or the participating stores. Benefits and privileges on E-Coupon will be stored on a Computer Chip of the Card and, upon the presentation of the E-Coupon, the Cardholder can make a redemption to obtain privileges or Benefits under the Terms and Conditions specified therein.
    • “Paper Coupons” means paper coupons printed out from the card receiver machine and not being recorded on a Computer Chip. The Cardholder can redeem a Coupon at participating stores for special privileges and Benefits when purchasing goods or services under the terms and conditions specified on the Paper Coupon.
    • “Electronic Vouchers (E-Vouchers)” means bills in the form of an electronic voucher stored on a Computer Chip of the Card given to the Cardholder under conditions set out by the Company and/or participating stores. The Cardholder can purchase E-Voucher in advance via the Smart Purse Card and use an E-Voucher in lieu of cash for products and/or services under the terms and conditions specified on the E-Voucher.
    • “Points” means points issued by the Company and/or the participating stores and can be accumulated.
    • “Benefits” means all the privileges stored on the Computer Chip of the Card, in the form of Points, E-Coupons and any other privileges to be offered to the Cardholder in the future.
  2. Accumulation of Points
    • Points will be recorded in the Smart Purse Card every time that the Cardholder purchases goods or services through the Smart Purse Card from the stores or places of service participating in the Smart Plus Rewards Program, provided that the amount of Points given is subject to terms and conditions as determined occasionally by each store.
    • Points stored in a Smart Purse Card cannot be redeemed for cash, and cannot be transferred to any other person.
    • The Cardholder may check accumulated Points at the Service Points determined by the Company.
  3. Points Redemption
    • The Cardholder can redeem Accumulated Points for rewards and/or goods and/or services at any time under the terms and conditions set out by stores having the Symbol of Smart Plus Rewards as determined by the Company.
    • The Cardholder must use the Smart Purse Card by himself/herself. The Company reserves the right not to be held responsible for damages arising from the use of the Card by a third party with consent of the Cardholder and/or any fraud committed, by the Cardholder and/or a third party, in ways of using the Card or redeeming Points.
    • Any disputes in regard to rewards and/or goods and/or services the Cardholder may receive from the redemption under this program shall be held as a direct responsibility of the participating stores.
    • Rewards and/or goods and/or services received from the redemption cannot be refunded, transferred or exchanged for cash for any reason.
    • Every 50 Smart Plus Points is worth 1 baht, however this redemption rate is subject to change under the terms and conditions set out in the Smart Plus Rewards Program as prescribed in Section 7.4
  4. Validity of Smart Plus Points The Points will expire upon the expiration of the Smart Purse Card.
  5. Use of Benefits in other categories of the Card.
    • In the event that the Cardholder receives any Benefits from the stores, such as an E-Coupon, an Instant Discount, a Paper Coupon or an E-Voucher, the Cardholder can redeem such Benefits under terms and conditions determined by the stores. Any dispute in regard to goods and/or services and/or coupons and/or discounts obtained by the Cardholder from exercising the right under this program shall be held as a direct responsibility of the stores.
    • E-Coupons, Instant Discounts, Paper Coupons, E-Vouchers and other Benefits that the Company and stores will provide to the Cardholder in the future can neither be refunded for cash nor transferred to a third party.
  6. Terms for Benefits of the Card.
    • 6.1 In the event that the Card expires, the Company sets conditions as follows;
      • If the Cardholder does not wish to buy a new Card, the Company will renew the Card for 30 days commencing from the expiration date in order to grant the right to the Cardholder to redeem the Points and Benefits on the Computer Chip in the Card under the conditions prescribed in the program. If the Cardholder fails to redeem the Points and Benefits stored in the Computer Chip of the Card for rewards and/or goods and/or services within 30 days, the Smart Plus Points and Benefits stored on the Computer Chip of the expiring Card shall be cancelled pursuant to the term of the Smart Purse Card as determined by the Company.
      • The Company will grant the right to transfer the Points and other types of Benefits, such as the Monetary Value, coupons, and the Points stored in the Computer Chip of the expiring Card to the new Card when the Cardholder buys a new Card in the name of the same person and/or of the same type and/or of the same pattern as the original Card, within 30 days from the expiry date of the original Card. The Cardholder can contact the Company’s Customer Relations Center within that period of time in order to request the Company to transfer the Points and Benefits from the original Card to the new Card. The Company reserves the right not to transfer any Points and Benefits, as well as any other data in the Computer Chip of the Card to another Card if the storage capacity of the Computer Chip of the receiving Card is full. In such a case, the Cardholder shall use the Points and Benefits as recorded in the original Card in order to reduce such stored data so that it is able to be transferred to the new Card.
    • 6.2 Defective Card
      For defective Cards, Section 8 of the Terms and Conditions of the Smart Purse Card shall apply.
    • 6.3 Card Cancellation and Cash Refund of the Balance of the Monetary Value Before the cancellation of the Card and the cash refund of the remaining Monetary Value as stipulated in the Schedule attached to the Terms and Conditions of the Smart Purse Card, the Cardholder should check the Points and Benefits in the Card in order to redeem all rewards and/or goods and/or services that the Cardholder is entitled to. When the Cardholder submits the Card Cancellation Form and claims a cash refund of the remaining Monetary Value from the Company, it shall be deemed that the Cardholder has waived the Cardholder’s right to redeem rewards and/or goods and/or services and any Benefits in the Card, commencing from the date of submission of the form.
    • 6.4 Theft or Loss
      If the Card is stolen or lost, Section 12 of the Smart Purse Card Terms and Conditions shall apply.
  7. Miscellaneous
    • 7.1 In the case of where the Cardholder receives rewards which are subject to withholding taxes and/or additional expenses such as fees, and taxes etc. due to the redemption of rewards, such as tourism activities, or any other reward the Cardholder shall be responsible for such fees, expenses, and taxes.
    • 7.2 The Company reserves the right to change the list of shops and service places, and the terms and conditions for granting Points for this program. The Company will notify the Cardholder of such changes through one of the available channels.
    • 7.3 The Company reserves the sole right to cancel the Smart Plus Reward Program at the Company’s discretion. The Company will notify the Cardholder and post written notice of such cancellation at the shops and service places participating in the program at least 60 days in advance, so that the Cardholder may exercise his/her right to redeem rewards and/or goods and/or services under the terms and conditions prescribed before the cancellation date of the Smart Plus Reward Program.
    • 7.4 The Company reserves the right to amend, modify, or add to any or all of the terms and conditions, provided that the Cardholder will be notified thereof at least 30 days in advance in writing or through one of the available channels.
    • 7.5 The Company reserves the right not to be responsible for any event in which the Cardholder cannot accumulate or has lost the Points arising from the occurrence of any force majeure event or from the Card being counterfeited.
    • 7.6 The Company reserves the right to cancel the Card and all the Benefits in the Card, and to refuse the transfer of the Benefits in the Card, if it is found that there is an occurrence of fraud, counterfeiting, or any fraudulent act in order to acquire Points for redeeming rewards and/or goods and/or services, either in part or in whole.
    • 7.7 In the event that the Company finds that the Cardholder has data, such as Monetary Value, coupons, Points and/or Benefits irregularly or suspiciously stored in the Card, the Company reserves the right to suspend and/or cancel such Card. After having examined such irregularity or suspicion and having found that there is no fault of the Cardholder, the Company will issue a new Card and transfer the actual accurate Benefits to the Cardholder.

The attached documents of Schedule of Terms and Conditions of Smart Purse Card

  1. In any event, if the remaining Monetary Value in the Card is less than or equal to the processing fee, the Cardholder shall contact the Company in order to collect the refund of remaining Monetary Value in the Card only from the Company.
  2. In the event of the expiry of the Card the Company, will renew the Card for a further period of 30 days commencing from the expiry date in order to grant the right to the Cardholder to make any transaction, with the exception of topping up the Card.
  3. Where the Card is defective, expired or cancelled, if the Cardholder needs a refund of the remaining Monetary Value, the Cardholder shall return the Card to the Company in order to comply with the terms and conditions prescribed by the Company.
  4. In the event that the Company charges the Card Status-Maintenance Fee and the balance of Monetary Value does not cover the Card Status- Maintenance fee, the Company shall cancel the Card and delete all data of the Card from the Company’s database.
  5. The Company reserves its right to change, cancel, or amend these Terms and Conditions as it deems appropriate.
  6. The Card sold cannot be refunded for cash.
  7. The documents stated in the Schedule means a copy of the ID card and a copy of the front page of the bank account book of the Cardholder, duly certified as true copy by the Cardholder.

** The Company reserves the right to remit money to the Cardholder by any other method deemed appropriate by the Company, such as the remittance of money to the Cardholder’s bank account, etc.
